The scandal surrounding Joe Biden’s use of an autopen to authorize official government actions has exploded into what many are calling a full-blown constitutional crisis, with House Oversight Chairman James Comer (R-KY) confirming that his committee has identified the White House staffers responsible for operating the machine during a period when Biden was allegedly in serious mental decline.
In a bombshell interview with Jason Chaffetz on Fox News, Comer revealed that not only were executive orders and pardons signed without Biden’s knowledge, but also that several of these decisions may have been made by unelected staffers, including controversial figures like Neera Tanden — who, according to watchdog group The Oversight Project, held the role of White House Staff Secretary during the period in question.
“We think we’ve identified who the staffers are,” Comer said. “We’re going to bring everyone we believe was involved in any role in the use of the autopen. We’re going to invite them to come in for a transcribed interview. If they decline, they will receive a subpoena and face a full-blown deposition.”

According to Comer, some of the autopen-signed documents include pardons for convicted criminals, executive orders designed to “Trump-proof” the federal government, and even legal decisions benefiting members of Biden’s own family. And it all happened, Comer argues, while Biden was clearly unfit to understand or approve any of it.
President Trump brought national attention to the issue in March when he declared Biden’s autopenned pardons “VOID” and demanded criminal investigations into who was wielding the autopen behind the scenes. “They should all be in jail!!!” Trump wrote on Truth Social.
Now, Comer and House Republicans are preparing to do just that.
The Oversight Project also found that every document signed by Biden in the final stretch of 2022 used the same autopen signature, including a batch of six pardons issued on December 30, 2022, while Biden was vacationing and golfing in St. Croix. Strangely, the only document not signed with the autopen was Biden’s announcement that he would not seek re-election — suggesting it was the only one he actually touched.
As this scandal deepens, the big question is no longer just who used the autopen — but who was actually running the country while Biden was mentally absent. And if Comer’s investigation proves that unelected staffers made presidential decisions without constitutional authority, we’re looking at nothing short of a silent coup inside the White House.
