Alina Habba Muzzled by Judge After ICE Nabs Newark Mayor in Federal Crackdown

So apparently, saying “no one is above the law” is now controversial — at least if you’re calling out a Democrat politician. U.S. Magistrate Judge André M. Espinosa issued a warning Friday to U.S. Attorney Alina Habba and ICE officials for making public statements after Newark Mayor Ras Baraka was arrested for trespassing at a federal immigration facility. Because nothing says “equal justice under the law” like telling prosecutors to be quiet while a politician-turned-governor-wannabe cries foul.

Here’s the recap: Ras Baraka, Democrat Mayor of Newark and now aspiring New Jersey governor, thought it would be a great idea to storm the Delaney Hall ICE detention facility with three left-wing members of Congress. The whole thing was an orchestrated stunt — yelling, cameras, and of course, no regard for federal authority or property. He ignored multiple warnings and was arrested for criminal trespass. You know, the law the rest of us are expected to follow.

After the arrest, Alina Habba — interim U.S. Attorney for New Jersey and longtime legal bulldog for President Trump — released a no-nonsense statement: “The Mayor of Newark… committed trespass… and has willingly chosen to disregard the law. That will not stand in this state.” Clear, factual, and completely justified.

But that apparently didn’t sit well with Baraka’s legal team, who ran crying to the judge during a virtual hearing. They argued that Habba’s statement was “derogatory” and might affect Baraka’s gubernatorial ambitions. Oh no! Imagine the horror of a politician being held accountable for their actions during an election cycle. What’s next — consequences?

Judge Espinosa, for his part, didn’t issue a gag order but “cautioned” Habba and ICE to avoid “out-of-court” statements. Right. Because the real problem here isn’t the Democrat mayor trespassing and inciting chaos at a secure facility, it’s the mean words said about him afterward.

But Habba isn’t backing down. On Monday, she confirmed that her office is now opening a federal investigation into the incident — specifically, the violent altercation between Congressional Democrats and ICE agents at Delaney Hall. She made it clear: “All available evidence will be thoroughly reviewed… I do not take these matters lightly.”

Good. Because someone has to take the rule of law seriously — even if that’s become too much to ask from Democrat mayors and their media allies.

Let’s be honest: if a Republican mayor had stormed a federal facility and physically confronted ICE agents, the DOJ would’ve had a perp walk on CNN by dinnertime.
